Revenue dept empowers revenue officials to trace, attach & even auction properties of defaulting builders to speed up MahaRERA recovery cases

Govt has also mandated monthly progress reports on recoveries

Pune: State govt has laid down a new procedure to speed up execution of MahaRERA orders and providing relief to stuck homebuyers, empowering revenue officials to trace, attach and, if necessary, auction properties of defaulting builders.The revenue department, through an order issued on Tuesday, directed authorities to accord top priority to recovery certificate and warrant cases arising from MahaRERA orders, citing their direct impact on flat purchasers. Senior officials said 1,421 such cases from Mumbai City, Mumbai Suburban, Thane and Pune involved outstanding dues of nearly Rs 975 crore. Of this, around Rs 350 crore had been recovered.The order, issued by revenue department joint secretary Kailas Gaikwad, laid down a detailed procedure for enforcement of MahaRERA recovery certificates. Under the new framework, if amounts payable as per MahaRERA orders cannot be recovered from a builder, officials will identify the defaulter’s assets and initiate recovery proceedings.To strengthen enforcement, resident deputy collectors across districts have been designated as dedicated revenue recovery officers. Every recovery certificate received by a district collector’s office will be separately recorded and forwarded to the concerned tehsildar within seven days. “After receiving a case, the tehsildar will issue a demand notice to the defaulter and require an affidavit disclosing complete details of movable and immovable properties. If dues remain unpaid within the stipulated period, attachment proceedings will begin, followed by steps to auction the property.” a senior MahaRERA official said.Govt has also mandated monthly progress reports detailing recoveries made, pending cases and reasons for delays, enabling closer monitoring of enforcement action.To trace defaulters, officials will access land and property records maintained by the revenue department, registration and stamp authorities, RTO databases and property tax records of local bodies. Information from the income tax department may also be sought where required.Officials said the move was expected to provide relief to homebuyers who have been waiting for compensation or refunds ordered by MahaRERA but delayed due to non-compliance by builders.
